Description/Abstract
An analytical trip through European case law in order to identify the ''exceptional circumstances'' that the European Court of Justice has applied when dealing with the overlap between competition law and intellectual property rights in Article 82 related cases. The article ends with a brief analysis and comparison of the corresponding US approach to the problem.
