In a long-winded and over-complicated analysis of the current law, the Court of Appeal in Global Process Systems v Syarikat Takaful Malaysia Berhad [2009] EWCA Civ 1398 overturned the decision of the High Court [2009] EWHC 637 (Comm). Waller LJ held that a narrower test than that accepted by Moore-Bick J in Mayban was the correct test and that Blair J had applied the wider test erroneously.
