The law on fraudulent insurance claims
This article aims to give an overview of the law on fraudulent claims as it currently stands. With reference to the Law Commissions’ recent Consultation Paper on post-contractual good faith, the second in the lengthy consultation process that has been going on since 2006, the author ventures mild criticism against the idea that the law is undeveloped and needs to be codified, but also recognises that the slow development of the law historically has had a detrimental effect on insurance contract law as a whole.
