Governing litter through criminalization
This article examines criminalization as a mode of governance through a case study of its application to the problem of littering. Employing the conceptual distinction between ‘formal’ and ‘substantive’ criminalization a descriptive account of the pattern of litter criminalization in England and Wales is provided. Through exploration of the concepts of ‘dramaturgy’, ‘legibility’, ‘algorithmic justice’ and ‘responsibilization’ this article explains the tendency towards criminalization as a mode of governance in this area and exposes its limitations. It concludes by arguing that the values of minimalism should be central to thinking about the governance of littering.
