The power conferred in 1883 to make declarations of right has transformed modern practice. A typology of declarations of title in English law is developed from a sample of 400 or so modern land law cases, covering declarations of subsisting, doubtful and future rights and negating claims and known clouds on titles, but the courts cannot declare a title valid against unknown claims.
