What are the procedural conditions for a shipowner or other entitled person to constitute a limitation fund? Can they do so without responding to a prior claim? Can the shipowner's right to limit liability be regarded as an absolute right? On 8 January 2016 SC Gupte J of the Admiralty and Vice-Admiralty Jurisdiction of the High Court of Judicature at Bombay gave judgment in Admiralty suit no 43 of 2012, answering these questions for his jurisdiction.
