B, 16 years old, was suffering from Diabetic Ketoacidosis, a life-threatening complication of insulin-dependent diabetes. B’s doctors wished to commence medical treatment to reverse the Diabetic Ketoacidosis; however, B refused medical intervention. Due to B’s worsening condition, University Hospitals Plymouth NHS Trust made an urgent without notice application to seek permission to administer intravenous fluids and insulin to B, notwithstanding B’s refusal of medical treatment. To determine whether the treatment was in B’s best interest, MacDonald J conducted a best interests’ assessment. This comment expresses concern with the extent to which B’s wishes and feelings were weighed in this case and submit that the court disregarded B’s wishes and feelings when conducting a best interests’ assessment.
