In this book, the right to share in joint ownership and limitations of this right are examined in accordance with the provisions of the Turkish Civil Code and the certain codes which are including limitations, supported by the decisions of the Supreme Court. The right to share in joint ownership is a special form of termination of the joint ownership. Because this is kind of a right that every owner can use by applying to the court without any justification or proof. While this right is intended to protect the property right of the individual, on the other hand, it should not be overlooked that the joint ownership may terminate without any justification or reliable evidence, in a way that harms the other right holders. Because in some cases, the termination of joint ownership may cause damage to all owners in terms of the timing of the application or the condition of the property.

The purpose of this book is to research all aspects of the right to share in joint ownership and especially limitations of this right.
