The plaintiff, ING Bank NV, was the Singapore branch of a Netherlands bank. The plaintiff had two regular customers: Aeturnum Energy International Pte Ltd (AEI) and HLT.

In order to finance HLT’s trading activities, there was an arrangement, known as the HLT Banking Facilities, between the plaintiff and HLT. The terms and conditions of this arrangement could be found in the HLT Facility Letter.

Abstract
