This paper charts the legal implications of the referendum to expropriate and nationalise the city’s apartments from corporate landlords that took place in Berlin on 26 September 2021. The constitutional basis for the referendum was the compulsory purchase provision contained in article 15 of the German Constitution. Article 15 authorises the Berlin State to transfer private land, natural resources and means of production into common ownership. The first part of the article explains the housing crisis in Berlin. The second part analyses the legal problems behind this referendum in Germany. The third part describes why the idea behind the art. 15 is workable under the German legal system. The end part underlines how the idea behind the referendum in Berlin could be a potential template for the housing systems in the European Union.
