A GDPR Lens on the Draft Article 28 DSA Guidelines and their approach to age assurance
This report reviews the main pillars of the draft guidelines through the prism of the GDPR in an attempt to assess whether the EC has succeeded in achieving the merger between online safety and privacy and data protection. For this purpose, it explores one of the thorniest issues in this context –age assurance– and highlights three key concerns raised by the draft guidelines, questioning whether the proposed framing strike an appropriate balance among the various rights and freedoms at stake.
