Déjà vu in data protection law: the risks of rewriting what counts as personal data
This paper aims to shed light on the potential impact of the proposed amendments to the GDPR. Much like the attempted definition in the UK Data Protection and Digital Information Bill, the proposed Digital Omnibus leaves room for a range of interpretations, some of which are highly problematic and largely disregard the current state of the art in statistical disclosure control methods. Second, this paper compares the proposed formulation with similar tests found in other legislation, particularly in US privacy laws, where the standards would then appear stronger.
